Praise be to Allah.<\/p>\n

The days of Tashreeq are the 11th<\/sup>, 12th<\/sup> and 13th<\/sup> of Dhu\u2019l-Hijjah. There are several verses and ahaadeeth which speak of their virtue:\u00a0<\/p>\n

1 \u2013 Allaah says (interpretation of the meaning):\u00a0<\/p>\n

\u201cAnd remember Allaah during the appointed Days\u201d<\/p>\n[al-Baqarah 2:203]\n

These are the days of Tashreeq. This was the view of Ibn \u2018Umar and most of the scholars.\u00a0<\/p>\n

2 \u2013 The Prophet (peace and blessings of Allaah be upon him) said concerning the days of Tashreeq: \u201cThey are days of eating, drinking and remembering Allaah.\u201d Dhikr (remembering Allaah) is enjoined during the days of tashreeq in several ways:\u00a0<\/p>\n

-Remembering Allaah immediately after the prescribed prayers by reciting Takbeer. This is prescribed until the end of the days of Tashreeq according to the majority of scholars.<\/p>\n

-Remembering Him by saying Bismillaah and Allaahu akbar when slaughtering the sacrificial animal. The time for slaughtering the hadiy and udhiyah lasts until the end of days of Tashreeq.<\/p>\n

-Remembering Allaah when eating and drinking. It is prescribed when eating and drinking to say Bismillaah at the beginning, and to praise Him (say Al-hamdu Lillaah) at the end. According to the hadeeth narrated from the Prophet (peace and blessings of Allaah be upon him): \u201cAllaah likes His slave when he eats something to praise Him for it, and when he drinks something to praise Him for it.\u201d Narrated by Muslim, 2734.<\/p>\n

-Remembering Him by saying Takbeer when stoning the Jamaraat on the days of Tashreeq. This applies only to the pilgrims on Hajj.<\/p>\n

-Remembering Allaah in general. It is mustahabb to make a lot of dhikr during the days of Tashreeq. \u2018Umar used to recite Takbeer in Mina in his tent, and when the people heard him they recited Takbeer too and Mina echoed with the sound of their Takbeer. Allaah says (interpretation of the meaning):<\/p>\n

\u201cSo when you have accomplished your Manaasik [rituals of Hajj], remember Allaah as you remember your forefathers or with a far more remembrance. But of mankind there are some who say: \u201cOur Lord! Give us (Your Bounties) in this world!\u201d and for such there will be no portion in the Hereafter.<\/p>\n

201.\u00a0And of them there are some who say: \u201cOur Lord! Give us in this world that which is good and in the Hereafter that which is good, and save us from the torment of the Fire!\u201d\u201d<\/p>\n[al-Baqarah 2:200-201]\n

Many of the salaf regarded it as mustahabb to make a lot of du\u2019aa\u2019 during the days of tashreeq.\u00a0<\/p>\n

The words of the Prophet (peace and blessings of Allaah be upon him), \u201cThese are days of eating, drinking and remembering Allaah\u201d indicate that eating and drinking during the days of Eid are means that help one to remember Allaah and obey Him; perfect gratitude for the blessing means using it to help one obey and worship Allaah,\u00a0<\/p>\n

In His Book Allaah commands us to eat of good things and thank Him for them. So whoever uses Allaah\u2019s blessings to commit sin is showing ingratitude for the blessing of Allaah, so he deserves to have it taken away from him.\u00a0<\/p>\n

3 \u2013 The Prophet (peace and blessings of Allaah be upon him) forbade fasting on these days: \u201cDo not fast on these days, for they are the days of eating, drinking and remembering Allaah.\u201d Narrated by Ahmad, 10286; classed as saheeh by al-Albaani in al-Silsilah al-Saheehah, 3573.<\/p>\n

The ruling on not staying overnight in Mina during the Days of Tashreeq. If the answer is that (the one who does not stay in Mina) is obliged to offer a sacrifice, then should he offer a sheep for each night or is one sufficient?<\/strong><\/p>\n

Staying overnight in Mina during the Days of Tashreeq is obligatory according to the majority of fuqahaa\u2019; the one who fails to do that with no excuse is obliged to offer a sacrifice. According to the majority of scholars one should stay there for most of the night.<\/p>\n

(al-Mawsoo\u2019ah al-Fiqhiyyah, part 17, p. 58).<\/p>\n

Not staying overnight in Mina during the Days of Tashreeq may be one of the following cases:<\/p>\n

The first case: when a person does not stay overnight in Mina because he has an excuse.<\/p>\n

Shaykh Ibn Baaz was asked about the ruling on a person who does not stay overnight in Mina during the Days of Tashreeq. He said: \u201cHe is not obliged to offer any sacrifice because Allaah says (interpretation of the meaning): \u2018So keep your duty to Allaah and fear Him as much as you can\u2019 [al-Taghaabun 64:16] \u2013 whether he did not stay overnight at Mina because of sickness or because there was no room, of for some similar legitimate excuse such as those who bring water to the pilgrims and those who tend sheep, and whatever else comes under the same rulings.<\/p>\n

The second case: when a person does not stay overnight (in Mina) during the days of Tahsreeq with no excuse.<\/p>\n

The Shaykh (may Allaah have mercy on him) said:<\/p>\n

Whoever does not stay overnight in Mina during the Days of Tashreeq with no excuse has failed to do something which was prescribed by the Messenger of Allaah SAWS (peace and blessings of Allaah be upon him) in both word and deed, and by the fact that he made a concession for some of those who have excuses such as shepherds and those who bring water to the pilgrims. Concessions can only be made when there is something which has to be done. Hence staying overnight in Mina during the Days of Tashreeq is considered to be one of the obligatory duties of Hajj, according to the more correct of the two scholarly views, and whoever does not do that and has no legitimate excuse has to offer a sacrifice, because it was reported that Ibn \u2018Abbaas (may Allaah be pleased with them both) said: \u201cWhoever fails to do one of the rituals [of Hajj] or forgets it, let him offer a sacrifice.\u201d It is sufficient to offer one sacrifice for not staying overnight in Mina during the days of Tashreeq.\u201d<\/p>\n

(Majmoo\u2019 Fataawa al-Shaykh Ibn Baaz \u2013 may Allaah have mercy on him \u2013 vol. 5, p. 182)<\/p>\n

He should offer the sacrifice and share out its meat among the poor in the Haram, and he should not eat any of it. And Allaah knows best.<\/p>\n<\/div>\n
